1. Introduction & Acceptance of Terms
Welcome to GoTour & Travels. These Terms & Conditions ("Terms") govern your use of our services and your relationship with us. By booking a flight, hotel, or any travel service through GoTour & Travels, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Important Disclosure: GoTour & Travels is an independent travel agency operated by Sri Tharani Enterprise Co., Ltd. We are NOT affiliated with, endorsed by, or acting as an official representative of any airline, hotel chain, or travel brand. We facilitate bookings on your behalf through our partnerships with various travel providers.
If you do not agree to these Terms, please do not proceed with a booking. Your use of our services constitutes acceptance of all terms herein.
2. Services Provided
GoTour & Travels provides the following travel agency services:
- Flight Booking: We help you search, compare, and book flights from airlines and consolidators.
- Reservation Management: We manage your reservations, including seat selections and special requests.
- Flight Modifications: We assist with date changes, time changes, and route modifications subject to airline policies.
- Seat Upgrades: We coordinate upgrades where available and offered by airlines.
- Cancellations & Refunds: We process cancellation requests and facilitate refunds in accordance with airline and our policies.
- Customer Support: We provide telephone support to assist with booking inquiries and travel assistance.
All services are provided via telephone booking. We do not offer online booking transactions. All bookings must be arranged by calling our team at (432) 558-6151.
3. Booking Process & Confirmation
How to Book: To book travel services, contact us at (432) 558-6151. Our agents will assist you in selecting flights, hotels, or other services based on your travel needs.
Booking Confirmation: Once you provide payment information and agree to the itinerary, terms, and applicable fees, we will send you a booking confirmation via email. This confirmation includes:
- Your itinerary details and flight information
- Passenger names and contact information
- Fare breakdown and applicable fees
- Confirmation numbers for all travel segments
- Payment receipt and transaction details
Your Responsibility: You are responsible for verifying the accuracy of your booking information. Please review your confirmation immediately and contact us if any details are incorrect. Changes requested after confirmation may incur additional fees.
Payment at Booking: Payment must be received at the time of booking or at an agreed-upon time before your departure. We accept credit cards and other payment methods as discussed with our booking agents.
4. Payment Terms & Service Fees
Fare Components: The total cost of your booking includes:
- Airline Fare: The base ticket price charged by the airline or consolidator.
- Taxes & Surcharges: Government taxes, facility charges, and fuel surcharges imposed by airlines.
- Agency Service Fee: A fee charged by GoTour & Travels for booking services, customer support, and administrative costs.
- Credit Card Processing Fee: A processing fee if payment is made by credit card (applicable based on payment method).
Service Fees: GoTour & Travels charges a service fee for our booking and support services. This fee is separate from and in addition to airline fares and taxes. Service fees are non-refundable unless a booking is cancelled within the DOT 24-hour cancellation window (see Section 6).
Fare Guarantee: Fares quoted are subject to availability and may change without notice until your payment is received and your ticket is issued. We will confirm the final fare with you before processing payment.
No Refunds for Credit Card Fees: If you choose to pay by credit card, you agree to pay any applicable credit card processing fees. These fees are non-refundable.
Payment Methods: We accept credit cards (Visa, Mastercard, American Express, Discover) and other payment methods as discussed with our agents. Payment must be received before ticket issuance.
5. Fare Rules & Airline Policies
Airline Policies Control: All fares purchased through GoTour & Travels are governed by the terms and conditions of the airline or consolidator providing the flight. Airline rules regarding baggage, seat changes, cancellations, refunds, and other policies apply to your booking.
Fare Rules Variation: Different fares have different rules. At the time of booking, we will explain the specific fare rules applicable to your ticket, including:
- Whether the fare is refundable or non-refundable
- Penalties for changes or cancellations
- Restrictions on dates, times, or routes
- Baggage allowances and fees
- Seat selection and reservation policies
Your Responsibility: You are responsible for understanding and accepting the fare rules before booking. Ask our agents to clarify any rules you do not understand.
Changes to Airline Policies: Airlines may change their policies at any time. We are not responsible for changes made by airlines after your booking is confirmed. We will inform you of any material changes that affect your specific booking.
No Affiliation with Airlines: GoTour & Travels does not set airline policies, prices, or procedures. We are an independent agency that facilitates bookings on behalf of airlines and consolidators. Any disputes regarding airline policies, schedules, or services should be directed to the airline directly.
6. DOT 24-Hour Cancellation Rule
Your Right to Cancel: Under U.S. Department of Transportation (DOT) regulations, you have the right to cancel your booking and receive a full refund if:
- Timing: Your booking is cancelled within 24 hours of booking confirmation; AND
- Advance Purchase: Your flight is scheduled to depart at least 7 days from the date of booking.
Full Refund: If you meet both conditions above, you are entitled to a full refund of all fares and taxes paid, including our service fee.
How to Cancel: To cancel within 24 hours, contact us immediately by telephone at (432) 558-6151. Our agents will process your cancellation request and arrange your refund.
Refund Timeline: Full refunds for bookings cancelled within the 24-hour window will be processed within 5-7 business days from the cancellation request date.
Outside the 24-Hour Window: Cancellations after 24 hours are subject to our standard cancellation policy and applicable airline penalties (see Section 8).
Non-Applicability: The 24-hour rule does not apply if your departure date is less than 7 days away at the time of booking.
7. Changes & Modifications
Changing Your Booking: If you wish to change your flight dates, times, destinations, or passenger names, contact us at (432) 558-6151. We will assist you in making changes subject to airline policies and availability.
Change Fees: Airlines may impose change fees or fare difference charges. These fees vary by airline and fare type. We will inform you of any applicable fees before processing your change request.
No Guarantee of Availability: We cannot guarantee that your requested change will be available. Changed flights depend on availability at the time of modification. Your original itinerary may not be available if you wait to make changes.
Passenger Name Changes: Most airlines do not allow passenger name changes or corrections after booking. If your name is spelled incorrectly on your ticket, contact us immediately for assistance. Name corrections may require rebooking and additional fees.
Special Requests: Special requests such as seat selections, meal preferences, and service animal accommodations are subject to airline approval. We will submit your requests but cannot guarantee accommodation.
Change Processing: We charge a service fee to process booking modifications. This fee is separate from any airline change fees or fare differences.
8. Cancellation & Refund Policy
Cancellation Rights: You may cancel your booking at any time by contacting us at (432) 558-6151. However, your refund entitlement depends on the specific airline's policy and the fare type purchased.
Refundable Fares: If you purchased a refundable fare, you are entitled to a refund of the airfare and taxes if cancelled. The timing and method of refund depend on the airline.
- Refunds are typically processed within 30-60 days from the cancellation request date
- Refunds are issued as airline credit or to the original payment method, depending on the airline
- Our service fee is non-refundable unless cancelled within the DOT 24-hour window
Non-Refundable Fares: If you purchased a non-refundable fare, you are generally not entitled to a cash refund if you cancel. However:
- You may be eligible for an airline credit (voucher) for future travel
- The amount of the credit is determined by the airline and may be less than the original fare
- Airline credits typically have expiration dates and restrictions
- Our service fee is non-refundable
Cancellation Fees: Some fares include cancellation fees. These fees are determined by the airline and will be deducted from your refund or credit.
Processing Cancellations: We charge a service fee to process cancellation requests and coordinate refunds with airlines. This fee is separate from any airline cancellation penalties.
Refund Processing Timeline: Once your cancellation is processed, refunds are typically issued within 5-30 days, depending on the airline and payment method. Some airlines may take up to 60 days to process refunds.
No-Show Policy: If you do not show up for your flight and do not cancel in advance, you forfeit all monies paid for your booking. No refunds are provided for no-shows.
9. Prohibited Uses
You agree not to use GoTour & Travels' services for any unlawful purpose or in violation of any laws or regulations. Specifically, you agree:
- No Fraudulent Bookings: You will not make bookings using fraudulent, stolen, or counterfeit payment methods.
- No Identity Misrepresentation: You will not book flights using false or someone else's identity or passport information.
- Accurate Information: All information you provide (passenger names, contact details, payment information) must be accurate and truthful.
- No Reselling: You will not resell, transfer, or commercialize tickets or bookings obtained through our service without authorization.
- No Harassment: You will not harass, abuse, or threaten our staff or other passengers.
- Compliance with Laws: All bookings and travel must comply with U.S. federal, state, and international laws, including visa and passport requirements.
- Sanctions Compliance: You will not book travel if you are subject to U.S. government sanctions or travel restrictions.
Consequences: If we discover that you have violated these terms, we may cancel your booking, withhold refunds, and terminate our relationship with you.
10. Limitation of Liability
No Liability for Airline Actions: GoTour & Travels is not responsible for any actions, omissions, or decisions made by airlines, consolidators, hotels, or other travel providers. This includes:
- Flight delays, cancellations, or diversions
- Overbooking and denied boarding
- Baggage loss or damage
- Changes to airline policies or schedules
- Service failures or poor customer service by airlines
- Lost or damaged luggage
- Injuries or accidents during travel
Disputes with Airlines: Any disputes regarding airline services, schedules, policies, or incidents must be resolved directly with the airline. GoTour & Travels will cooperate but assumes no liability.
Limitation of Damages: In no event shall GoTour & Travels be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wages, or emotional distress, arising from your use of our services or any booking.
Maximum Liability: Our total liability for any claim is limited to the total amount of fees paid to GoTour & Travels for the specific booking in question.
No Warranties: We make no warranties regarding the accuracy of information provided by airlines, the availability of fares, or the success of any booking modification.
Force Majeure: GoTour & Travels is not responsible for any failure to provide services due to circumstances beyond our control, including but not limited to natural disasters, war, pandemics, government actions, or technical failures.
11. Governing Law & Dispute Resolution
Governing Law: These Terms & Conditions are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.
Jurisdiction: Both you and GoTour & Travels agree to submit to the exclusive jurisdiction of the courts located in Cook County, Illinois, for any legal action or proceeding arising from these Terms or your use of our services.
Arbitration: For any dispute, you agree to contact us first at (432) 558-6151 or contact@gotourandtravels.online to attempt to resolve the matter informally. If informal resolution fails, you agree to binding arbitration rather than litigation, except as described below.
Class Action Waiver: You agree that any arbitration or legal action shall be conducted on an individual basis only and not as a class action or representative action.
DOT & Regulatory Compliance: Nothing in these Terms limits your rights under U.S. Department of Transportation (DOT) regulations or other applicable consumer protection laws. For complaints regarding airline service or DOT compliance, you may file a complaint with the DOT at aviation-consumer-protection.dot.gov.
